The Delhi High Court has made a significant development in Sunjay Kapur's inheritance case, valued at approximately ?30,000 crore. The court has declined to order a "confidentiality club" after counsels agreed not to disclose asset details and case information to the media. This decision comes after Priya Kapur's request for a non-disclosure agreement (NDA) binding Sunjay's children from his previous marriage, Samaira and Kiaan, was met with skepticism by the court.
Justice Jyoti voices concerns
Justice Jyoti Singh voiced concerns, stating that an order could be "problematic" as it might hinder the children's ability to challenge disclosures. "How will you file a written reply and argue cases if everything is in sealed cover?" she questioned. "If they are bound by confidentiality, how will they ever defend their case?"
Order for Priya Kapur
Priya Kapur withdrew her NDA demand by Friday, opting for sealed cover submissions. This approach protects sensitive documents from public view while granting access to involved parties. For Samaira and Kiaan, this means they retain the right to scrutinize and contest the Will, which they have labeled a "bogus Will," accusing Priya Kapur of emptying Sunjay Kapur's bank accounts.
What exactly Justice Singh said
Justice Singh mandated an inventory of Sunjay Kapur's assets, both movable and immovable, to be presented to the court and shared with his mother, Rani Kapur, and his children from his first marriage. The court prohibited public disclosure of this information, and it also rejected Priya's NDA request.
"The court emphasised that heirs have an unquestionable right to know the details of an estate they may be entitled to. They have no issues disclosing the assets. All that was said, let this not be made public. You have the right to know," Justice Singh noted.
Mahesh Jethmalani’s argument in the court
Senior advocate Mahesh Jethmalani, representing Samaira and Kiaan, emphasized in court that, "According to this patently bogus will, I have been deprived of everything. Two accounts have been wiped clean and 6% share has been appropriated. For me, there is nothing confidential. What is there to hide?"
Karisma Kapoor and Sunjay Kapur
Karisma Kapoor and Sunjay Kapur, who married in September 2003 and had children Samaira (born in 2005) and Kiaan (born in 2011), divorced in 2016. Following Sunjay Kapur's passing in June 2025, Karisma, acting on behalf of her children, has become involved in the legal proceedings regarding his estate. Samaira and Kiaan have petitioned the Delhi High Court, disputing the legitimacy of their stepmother Priya Sachdev's claim to the inheritance, alleging that Sunjay's will was forged.
The children argued that they had neither been shown the original nor provided a copy of the contested will. Consequently, they had requested the court to furnish them with a copy of the document.
