The Jiah Khan case has recently resurfaced in the news. Jiah's mother, Rabia Khan, recently testified before a special CBI court in Mumbai, alleging that Sooraj Pancholi emotionally and physically tortured her late daughter. Following that, rumours appeared that a psychologist had submitted a report to the CBI court claiming that his interview with Sooraj, in which he had to analyze information from the actor, was inadequate and fabricated due to Sooraj's apparent lack of cooperation. However, recent reports indicate that Rabia was attempting to delay the trial by maintaining that it was a homicide.
Well now, according to a report from a leading news portal, the Bombay High Court rejected a petition submitted by Rabia Khan seeking a new investigation into the Jiah Khan case, preferably by the FBI, the United States domestic intelligence and security organization. The matter is still being investigated by the Central Bureau of Investigation, which has charged Jiah's boyfriend, actor Sooraj Pancholi, with abetting her suicide on June 3, 2013.
Reportedly, the bench of judges carried out by the CBI from all possible angles stated that it was a case of suicide. While Rabia Khan believes her daughter was murdered.
The report quoted the court's statement, "Repeated insistence of the petitioner to procure a finding from the Court that death of the victim, in this case, was homicidal and not suicidal is a clear indication of procrastinating the trial,"
The entire approach of Rabia Khan appears to procure an order from this Court, without facing trial, that the death of the victim was homicidal and not suicidal. This kind of approach appears to circumvent the due process of law, the HC said.
The bench added that every aspect of the clinical and circumstantial evidence, the behaviour of the accused, and/or the incident's cause were reexamined from a fresh perspective in order to determine and verify whether it could be a case of "homicidal death," and only after it was determined that it was a case of suicidal nature.
