The client in emotional state was saying jail mein daalo but Abhira would have told them aisa nahi hoga. but Ruhi's deeds even if not deliberate definitely could have had even worse consequences- injuring and killing more than one person and that all deserves to go on her record without all charges and things simply being dropped which is what Goenkas are trying to do.

If somebody is a flight risk , they're not allowed In flights, first thing first ..imprisonment , charges or fine comes later..

There is no insaf here really which she's fighting for..

According to section 279 "Whoever drives any vehicle, or rides, on any public way in a manner so rash or negligent as to endanger human life, or to be likely to cause hurt or injury to any other person, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both"

So besides revoking driving licence Ruhi can be imprisoned for 6 months as her rash driving caused injury (unless the person was drunk which is most likely in this case). Medical examination can easily prove head injury and multiple fractures caused by accident (Kaki's husband was severely injured if not dead, he didn't have bruises but injuries). But yes, Abhira is going to lose this case as, Ruhi was never ever proven wrong (with EMA, obsessiveness, psychopathic traits, suicide drama and manipulations she is still a wayyy better character for writers). She has always been the victim of circumstances (according to writers) so this time too she will be proven innocent.

ANY yrkkh family is better than Goenkas. Maheshwaris, Singhanias, Birlas and now Poddars all are better than Goenkas who raised their children to become criminal or immoral individuals concealing thereby encouraging their crimes/mistakes. From Luv-Kush to Ruhi all of them have few specific Goenka traits. Kartik, Akshu and even Abhira also have Goenka traits.

So he will be upset with Abhira for sure!!

I mean yes, we as the viewers know the history with Manish but Abhira doesn't! So she will be devasted if Manish hates her because she genuinely cares about Manish. Hence why I said she is risking her relationship with Manish.

BM'ed this thread for future reference. smiley36 BTW Ruhi won't be sent to jail I'm 100% sure smiley36 - Anything is possible with these writers smiley36

@bold Abhira also told Armaan not to take Ruhi's case but he did. In my opinion it's Armaan turn to make efforts for Abhira as he wants to win her trust back, definitely not saying Armaan should accept her unreasonable demands but staying away from his ex isn't an unreasonable demand specifically when ex is obsessed with Armaan.

Regarding the logic behind Abhira fighting the case or not, well Ruhi can easily get off by paying the fine but if family of concerned person who is injured because of rash driving, press charges against Ruhi she can be imprisoned for 6 months to three years alongwith compensation (according to section 279 and 337)

yeah that's true. Anything is possible with these writers smiley36

Ruhi has exposed herself to the risks of being punished for her actions because of her rash driving. We have been shown that she was driving like a maniac ignoring her parnanu who was following her asking her to slow down. So just because now she is crying and saying sorry- doesnt mean she didnt commit a mistake. whatever she deserves as punishment for her mistake, she will get that after the court hearing. Abhira is not plotting and scheming by fabricating evidence against her to get her punished for something she didnt do. if Ruhi is somehow proved to not be responsible for the accident, Abhira will have to accept that too. Abhira may be emotional but she is not doing anything immoral or unethical just because she is emotional about the issue. she says she wants to see Ruhi get her due- whatever that may be as adjudicated by the judge. the main thing that going to court establishes is that this stuff goes on Ruhi's record and her driving license will be revoked hopefully so that she stops being a risk to everyone. Whereas without court case, Ruhi would on paper still have a clean record and would still have her license intact. And its not Abhiras job to vouch for Ruhi and help her have a clean record. Its believable that after all that Ruhi has done, Abhira is not interested in playing unnecessarily nice. She has been nice before and been rewarded with heartache and malice from Ruhi and Goenkas.

No one is saying that she shouldn't face the consequences, she is facing the consequences of her reckless driving by compensating the injured person.

Also, no one is denying that she made a mistake, I think everyone agrees she has made a mistake, for which is paying by compensating the injured person.

Again, no one is saying that Abhira is plotting, scheming and fabricating evidence against Ruhi. There is a difference between this and being unreasonable, irrational, inexperienced and appearing as vindictive or petty.

No one is saying that Abhira is doing anything immoral or unethical, but that she is not competently dealing with this case legally as she is influenced by her emotions.

the main thing that going to court establishes is that this stuff goes on Ruhi's record and her driving license will be revoked hopefully so that she stops being a risk to everyone. But this is not what is shown in the episode. It's implied that Abhira wants Ruhi to be imprisoned by pursuing the matter in Court as that's her client's (unreasonable) demand.

Abhira is not interested in playing unnecessarily nice -- well that's not true, as we will see in the coming episode she is crying because of Manish. If that was the case, she shouldn't be affected by what Manish says to her.

It's not so much about Ruhi, but Manish. If you care about someone deeply and call them grandad, you wouldn't want to cause them grief. Abhira VERY WELL knows that dragging this matter to Court and trying to "teach" a lesson to Ruhi will upset Manish. Then you say it's her job, why should she give up the case - well because of her relationship with Manish. Just like she wouldn't go against Arman's dad or mum if they were the defendant, the same applies here.

If court case happens, judge will decide what and how much compensation Ruhi will need to give the injured person in an impartial way after hearing both sides.

Abhira was against Kaveri also in a case earlier knowing it would upset everyone but she still took it up because she's idealistic. So this situation is no different. Even then she tolerated peoples barbs, vitriol but did her job. It was about representing the people who needed her services and getting to the truth.

Manish who is a grandad figure being upset at her makes her sad but thats not reason enough to drop the case. She is fighting for the victim who has hired her and she will get them justice. The magnitude of punishment will be decided by judge and is not upto Abhira or anyone else. Her job is to only put forth the facts.

Even in an emotional state she is not gonna present any fake evidence to phasao Ruhi or anything.

Abhira states that her client wants insaaf and not rafa dafa'ing of matter with money and sorry and thats why the court case is happening. Court case ensures this stuff goes on her record too.

factoring in all the aspects of how negligent they were, what happened, are they repeat offenders or not- the judge will decide the magnitude of punishment.

thats precisely why a court case is happening. whatever is the max awardable punishment which is in line with the degree of offense committed and the track record of the accused- only that will be given by a judge

Abhira is not fabricating anything. she will present her client's facts and Armaan will present pro Ruhi facts too. and judge will decide.

For argument sake lets say Abhira wants Ruhi in jail. so? uss seh kya hojayega? Abhira ke chahne seh thodi na judge usko jail mein daalega. Judge will take into account all aspects and then give punishment

It's not about bribing the judge, but the possibility or risk of imprisonment if pursued in Court. Of course, it can go horribly wrong...Ruhi might be a terrible witness, the judge might not like her and at the same time, the judge might be very sympathetic to the plaintiff/applicant, and conclude that Ruhi deserves imprisonment.

Well, exactly my point - why is she dragging this case to Court when Ruhi's crime isn't of such serious magnitude?

thats precisely why a court case is happening. whatever is the max awardable punishment which is in line with the degree of offense committed and... well max awardable punishment can be imprisonment....but I thought you said Abhira doesn't want Ruhi to go to prison. If Abhira wants max punishment, this means she wants Ruhi to go to jail. That's precisely why Arman made the offer of settlement to avoid that risk and at the same time be held accountable by paying compensation to the injured person. Do you think Manish or Ruhi will care if Ruhi's licence is cancelled or she is fined, or she told to do community work? No, what they fear is the risk of imprisonment.

For argument sake lets say Abhira wants Ruhi in jail. so? uss seh kya hojayega? Abhira ke chahne seh thodi na judge usko jail mein daalega. Judge...I don't think the argument here is about what the judge decides, it's about Abhira's unreasonableness to pursue the case to Court, and exposing Ruhi to the risk of imprisonment.
