A Note for Beintehaa fans on d basis of indian laws of divorce for muslims !
In india , there r more stricter laws for divorce so that divorce matter is not taken lighty or in joke among muslims !
We had seen Dr. Zakir Naik's procedures for divorce ! according to him , after giving first divorce , husband shud wait for 3 months n den give second divorce to his wife n so on ! If we apply his procedures in beintehaa den til now zain's three divorces will be taken as one divorce ! But this procedure is not applicable in beintehaa as kaazi sahab (islamic legal scholar )shown in d show himself told zain about the divorce procedures n according to him just saying talaaq thrice in one sitting is not considered divorce ! so he asked zain to say talaaq to aliya in every month of iddah of aliya ! this is d actual way of divorce among sunnis ( a part of muslim community).
As per indian muslim laws of divorce, if the husband has divorced his wife three times then he can neither take her back during the iddah period nor after that unless she marries someone else and he divorces her ! but wife has to complete her iddah period even after third divorce n den only she can get married to a second man!
Quran clearly states that a divorce is permissible twice ! if a husband divorces his wife the third time then the divorce becomes irrevocable ! he cannot remarry her until she is married to someone else and he has divorced her ! this is called halala !
We hav witnessed that in beintehaa zain has clearly said talaaq thrice during iddah period n so dis divorce is irrevocable with regard to the yesterday's episode !
But we should not forget that halala is considered as a sin( haram) !
Rehaan considers zain as his brother and is also aware about zain aliya's paak relation so he wont agree to marry aliya n neither wud aliya marry rehaan as divorce from second husband is permitted only after they hav consummated their marriage ! moreover halala will delay zaya's union for quite some time and so beintehaa might lose its audience n m sure creatives wont do that !
Laws r laws n they cannot be changed for the sake of the show or else the muslim audience wud not connect with it ! they cannot show halala in a different way bcoz they cannot change d laws for
d show n hurt sentiments of muslim community !
zain just simply cannot remarry aliya n bring her back in his life aftr third divorce with new mehr no matter what ! indian laws of divorce doesnt permit the muslims to do so ! laws vary little bit
when it comes to variation in countries ! but all laws r based on Quran ! all those who feel it wil be that simple for zain to bring aliya back in his life then they r wrong ! if it was so simple zain wud
not hav panicked so much after knowing d truth behind domestic violence case and moreover we cannot forget that aliya said that after third divorce her return wud be next to impossible !zain is standing between two cliffs now ! Even if sanam tries to unite zain and aliya but she cannot change the laws bcoz zain has already divorced aliya thrice n final divorce was witnessed by sanam herself yestrday !
Zain aliya got married twice but their second marriage was done by fake names ! marriage wid fake names is not considered !
It doesnt matter that kazi sahab is present for each divorce ! basically husband and wife's presence matters the most and if we notice carefully , beintehaa team hav showed this divorce as its done
among sunnis( a muslim community) where witnesses r required ! suraiya and her family hav witnessed all the three divorces given by zain to aliya !
zain aliya hav not consummated during iddah period before third divorce so third divorce is irrevocable as per muslim laws of divorce ! this can b clearly seen as after every 2- 3 hours clock was
shown along with zain aliya's night scene !
third divorce is considered to b d final divorce in india and it doesnt matter if it was given bcoz of misunderstanding .
It is not possible that they show it as dream as producer's love note for fans clearly indicates that divorce was not a dream !
Pregnancy can only extend their iddah period but not cancel divorce ! At the most they can show aliya two months pregnant now .. aftr 4 months of consummation ! But chances of showing aliya pregnant r less now !
