"STAR PARIVAAR AWARDS 2009 (POLL)" ("Poll") will be held on STAR PLUS ("Channel") as stated hereunder:
1. The Poll shall commence from May 21, 2009 at 12:00 noon upto June 4, 2009 at 12:00 noon ("Period") on the Channel.
2. The Channel will telecast on-air promos wherein the viewer(s) will be asked to vote for one of their favorite (i) Pati i.e., husband and/or (ii) Patni i.e., wife and/or (iii) Jodi i.e., couple and/or (iv) Yogya Jodi i.e., compatible couple and/or (v) Pratiyogi and/or (vi) Naya Sadasya i. e. newcomer (Male) and/or (vii) Naya Sadasya i.e. newcomer (Female) (vii) ("Category(ies)"). The on air promos will also state the manner in which the viewers can vote.
3. The viewers interested in casting his/her vote for the Categories, can opt for the following two methods:
3.1 By SMS - The viewer must SMS "SPA" to 57827. Thereafter, the viewer would get an SMS which would set out the first Category stated above in rule 2, along with the nominations for that particular Category. On receipt of the aforesaid reply SMS, the viewer may select any one nomination within the stated Category and send SMS to 57827 to cast his/her vote. Similar process will be followed for subsequent Category(ies). Viewer(s) must vote for only those nominations listed in the SMS. Once a viewer(s) sends SMS with the keyword "SPA" to 57827, the viewers will continue to receive SMS's for each Category along with the nominations for that Category in the order stated in rule 2 above.
3.2 Internet - Log on www.starplus.in ("Website") and carefully follow the instructions thereafter given on the Website. The cost of the Internet session shall be solely borne by the viewers.
4. The viewers who are subscribers of Vodafone, Airtel, BPL, Idea, Reliance Communications, Spice, Aircel, Reliance Telecom, Tata Indicom, BSNL and MTNL (Mumbai) can cast vote via SMS.
5. The cost charged to the viewer(s) per SMS by the respective mobile operators will be as follows:
5.1 Rs. 3: Vodafone, Airtel, BPL, Idea, Reliance Communications, Spice, Aircel, Reliance Telecom, Tata Indicom;
Rs. 2: BSNL;
Rs. 1: MTNL Mumbai.
7. Neither STAR India Private Limited ("STAR India") nor the Channel shall be responsible in case of any network problem and/or the costs charged by the mobile operator. Any dispute in connection to the same shall be settled directly between the subscriber and the mobile or landline operator without involving STAR India and/or the Channel.
8. In case of telecom and/or network failure and/or for any reasons whatsoever, STAR India reserves the right to change the voting system/mechanism and/or cease from accepting votes of the viewers for any and/or all the Category(ies), or take such necessary steps as it may deem fit.
9. Votes sent by the viewer(s) for their favorite Category(ies) after the Period stated above shall not be considered and shall be invalid.
10. It is expressly stated that this is simply a Poll to enable the viewers to choose their favorite nominee(s) in each Category. Therefore, there shall be no winners declared or prizes distributed for this Poll.
11. It is expressly stated herein that unclear SMS and/or entry, incomplete SMS and/or entry/vote, SMS containing wrong characters, faulty SMS etc. will not be considered and shall be considered as invalid entry.
12. All the entries should state all the required information, which have been asked from them.
GENERAL RULES
1. STAR India or the Channel reserves all rights to make amendments to the existing rules without prior notice.
2. The viewer interested in participating in the Poll must be above the age of 18 years and a resident of India.
3. The voter(s) of the Poll agrees that he/she shall hold harmless the Channel, STAR India, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her, in any manner, whatsoever in connection with the Poll and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the sponsor and/or the Channel and/or STAR India to claim any damages or relief's or otherwise.
4. The Channel and/or STAR India is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the voter in any manner whatsoever, in connection to the Poll.
5. Employees of the Channel, STAR India, and the members of their immediate family, persons with criminal convictions, persons other than citizens of India, are ineligible to vote and be part of the Poll.
6. Non-conformance by a viewer of the rules of the Poll will make such viewer's votes null and void.
7. STAR India reserves all rights to make amendments to the existing rules and regulations without prior notice. It shall be the sole responsibility of the viewers to check the rules and regulations of the Poll on the website of STAR India.
8. The participation of the viewer(s) in the Poll shall mean that the viewer (s) has read, understood, accepted and agrees to abide with all the rules including the general rules of the Poll.
9. Employees of and/or consultants of and/or persons hired on contract by the Channel, STAR India and the main sponsor of the Star Parivaar Awards, if any, and the members of their immediate family are ineligible for voting through this Poll.
10. The outcome of the Poll/the decision made by the Channel and/or STAR India regarding the Poll shall be final and binding on the viewers and in no event shall the viewer/voter dispute the decision made by STAR India, Channels and/or its employees in connection to the Poll.
11. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Poll shall be referred to a sole arbitrator appointed by STAR India and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. The costs, charges and expenses in connection to arbitration shall be solely borne by the viewer(s) disputing.
12. Subject to the provision of Clause 11 above, the Courts having jurisdiction under the provisions of the Arbitration and Conciliation Act, 1996, to determine all matters which the Court is entitled to determine under the Act, including, without limitation, provision of interim relief's under the provisions of Section 9 of the Arbitration and Conciliation Act, 1996, shall exclusively be the courts at Mumbai, India
