She kept mum. I seriously don't understand how people go in day and night defending domestic violence.

Courts will say that "the woman consented to divorce happily and wasn't forced out of her marital home and befrauded poor old Dr. Birla after killing his brother lol."

Imagine if Akshara goes to court and says that the hospital owned by her in-laws led her to believe that she had miscarried both her foetuses, then her in-laws and husband accused her of killing her babies (lets forget the fact that foetuses are not medically, ethically, or legally "babies")

Then they kicked her out, she met Abhinav, hit it off and got to know that she's pregnant, filled in the birth certificate and married him.

Whom will the court side with?

Keeping in mind that a) unwed mothers are not obliged to provide a father's name b) it's well within her rights to fill in a non-biological father's name in the birth certificate if done with his consent. Dubious paternity cases are civil suits not criminal suits.

Sorry, I don’t think having an emotional outburst is abuse. The things he said in that state of despair and frustration are unforgivable - not denying that. He definitely needed counseling to manage his temper.

Regarding physical aggression- I would say its very subjective- for you it could be DV but such aggression and even manhandling (holding Abhimanyu’s collar in anger) has been done by Akshara quite a few times too. So in this particular case, given how both their characters have been portrayed - no it isn’t violence. I am not saying it’s responsible or mature behavior either but cannot be termed abusive. If it were abusive, Akshara wouldn’t try to inform him about the pregnancy! She made those attempts because even though she was deeply hurt and traumatized by the events - didn’t think of him as a bad or abusive person. So as per the story too I believe Abhimanyu is aggressive and impulsive yes but not abusive.

Agree that she isn’t obliged to fill father’s name - but she did fill in someone else’s name without the actual father’s consent so it does become an offense!

Ideal court ruling for custody in my opinion could be Abhir staying with Akshara and Abhimanyu getting visitation rights and also responsible for child support. But when have the makers shown something practically or realistically that they’ll start now?

The Supreme Court of India says asking a woman to leave her marital home is domestic violence and falls under the act. It wasn't "listen, the relationship is so broken, leave if you want to"

It is "get her out of my sight" by best maata and that being enabled by soulmate, interesting extraordinaire hero. You wishing to debate about this won't change the fact that Akshara did not have a choice, and that would be interpreted as domestic violence in every court of India because the Supreme court says so.

Paternity frauds are civil suits, not criminal suits. She doesn't require anybody's permission to fill in the birth certificate. Abhinav would have countersigned the birth certificate application ascertaining his consent and that pretty much it lol

He said he wanted her to sign divorce papers and leave. There’s a difference. If Akshara didn’t sign the papers - and Abhimanyu made her leave then yes it would have been domestic violence. Yes Akshara was in a vulnerable state but she did sign the papers. She left after signing the papers as he asked of her. So we can’t really debate that he threw her out. What happened with Akshara shouldn’t have happened to anyone especially in that state I completely agree and it is Abhimanyu’s fault that his marriage failed because he couldn’t empathize with her then. He was too caught up in his own grief - which left him alone at the end. Akshara only ever wanted a family of her own since the season started and that day she left because she felt that this cannot be her family. Isn’t that what she tells Abhimanyu during that temple confrontation?

Not going to get into what Manjiri said or did.

Firstly, I cannot believe people striving so hard to find loopholes in a clear cut instance of domestic violence.

Manjari asking her to be removed from her marital home even before she signed anything is an instance of domestic violence. She, as per Hindu Marriage Act, had property rights in the Birla Household; she cannot be asked to get out of there. I don't remember Raja beta protecting his wife from his mother's abuse. He, in fact, enabled it.

Like a man cannot be forced to be in an unwanted marriage, a woman cannot be unduly forced to sign divorce papers. The divorce becomes contested when one party wants it and the other party doesn't.

By your own statement :

He said he wanted her to sign divorce papers and leave.

Where is the room for her free will and consent here lol?

If Akshara had refused would "iski shakal nahi dekhni mujhe, iski vajah se saari mautein huyi hain, isse kaho yahan se jaane ke liye" wali good sasu and her raja beta let her live in peace?

Btw, accusing a spouse/DIL of baseless murder, showing agression and threatening them with economic retribution (like kicking someone out of a home) falls under DV act of 2005.

These are the literal defintions and clauses

  1. harms or injures or endangers the health, safety, life, limb or well-being, whether mental or physical, of the aggrieved person or tends to do so and includes causing physical abuse, sexual abuse, verbal and emotional abuse and economic abuse; or
  2. harasses, harms, injures or endangers the aggrieved person to coerce her or any other person related to her to meet any unlawful demand for any dowry or other property or valuable security; or
  3. has the effect of threatening the aggrieved person or any person related to her by any conduct mentioned in clause (a) or clause (b); or
  4. otherwise injures or causes harm, whether physical or mental, to the aggrieved person."

Just because people don't file cases against their family members doesn't mean domestic violence ceases to exist.

Whatever people say what happened with Akshara comes under DV.

When Divorce ka case chal raha hain tab bhi wife can't be asked to leave she can live in that house.

Uper se Birla hospital mein galat reports, equipments.

Kaand he kaand hain uss side se.

But just signing of Divorce papers in no Divorce

There is a 7 yrs leap which means Abhira are no longer married.

But Akshnav marriage is also not legal bcoz it didn't happened after Divorce or after 7 yrs of Abhira staying away from each other.

Drama likhne ke liye kaafi kuch hain makers ke pass but nahi unko sirf Manjiri ki bakwas and Abhir and Ruhi ki innocence ke saath sirf khelna dikhana hain.

Mujhe ek doubt.is this worst a discussion of law kya..dkp production never going to apply any legal information..they randomly pick if or twitter post and implement it one epi .and then seeing trp cancel that scene itself
