And somebody was discussing maintenance/alimony. Now since bhalla family worships matarani it's obvious that they are Hindus and are bound my Hindu personal law and according to Hindu marriage ACT, Sec 24&25 (if am not mistaken) deals with maintenance during pendency of petition and post divorce ,both these provisions says that the party demanding alimony MUST be incapable of supporting herself on her own (only then will maintenance be awarded )and the party(demanding alimony) and the court in granting alimony must take into consideration the earning capacity of the individual who is being asked to pay and should allow only that sum of money as maintenance which the party can afford (after deducting what he needs for himself). Finally my family law paper came in handy and the person who discussed that,Thanks dude, you penned down a point that has been running in my mind for quite a while now
