That is the difference.

If my parents are Bengali and I live in Punjab and speak Punjabi from Day one my MT will be Bengali though my First language will be Punjabi.

If my parents are Punjabi and I speak Punjabi fluently, then my MT and First language is Punjabi.

First language/mother tongue, is what a child learns at home from their parents.
You can have more than one mother tongue or native language.

Say what your mother tongue is and then say which language you want to translate and why.

Instead say directly, first language only reflects you did not understand the question.

My point of clarification was
Mother tongue/first language have a muddy distinction- your mother tongue may not be your first language
However, most people will overlook this and consider mother tongue and first language the same.
Even in linguistics, we find it hard to distinguish the two. It considers mother tongue/first language to be what you learn as a child, not where you are from or what your parents speak.

Your court of law, with the isolated case you stated, points in a different direction.

So I think what you meant to say was she should have stated her mother tongue as- Punjabi, and her second language as- English.

Which I agree with.

English is not our first language. Hindi is our national language and we should respect it.

BTW as usual teh focus became so much Bani dat everyone else's dialogues got totally ignored.

Bani should be addressed as UBI - Unfortunately Born in India.
