The Delhi High Court sided with Aishwarya Rai Bachchan on Thursday, ruling that her name, image, and personality traits are protected. Unauthorized use of these elements is now prohibited, ensuring her consent is required for any commercial or public application.
Justice Tejas Karia, in his ruling, not only barred numerous companies and individuals from such misuse but also emphasized that it causes financial harm and infringes upon her dignity.
“Any infringement of the plaintiff's personality rights, while causing confusion amongst the members of the public regarding endorsement or sponsorship of a product or service by the plaintiff, will also lead to dilution of the plaintiff's reputation and goodwill,” the order stated.
“In other words, the unauthorised exploitation of the attributes of an individual’s personality may have two facets – first, violation of their right to protect their personality attributes from being commercially exploited; and second, violation of their right to privacy, which in turn leads to undermining their right to live with dignity," it added.
“Personality rights allow a person to control and protect how their image, name, and likeness are used,” the court stressed.
The High Court clarified that unauthorized use of Aishwarya Rai Bachchan's identity creates a false association with products or services, potentially damaging her reputation and fame.
The court underscored that identity and dignity are vital, and unauthorized use is a rights violation. This ruling marks a significant advancement in personality rights, addressing celebrity complaints about identity misuse. It protects individuals by ensuring their consent is needed for any use of their persona, safeguarding their reputation.
The next step is to await the court's decision on Abhishek Bachchan's personality rights case, as he also approached the Delhi High Court on this matter.
