The biggest give away of dev's intentions is when he woke up in the out house... Under those conditions, the first thing a person asks is where am I, while gaining conscious... Which he did not...
Lets assume he recognized the outhouse... Then he should have asked how did he reach the outhouse or KM for that fact...

That scene itself according to me gave away Dev's real intentions...
Also if he was soooooooooooooooo worried bout Bro aur unki khushi n wanted to do something good, she should have quietly walked off KM, which he did not... He announced his departure everytime....

Medha, agreed that his sentence will commence only after the trial but if he had confessed to the crime, then he can still be held as undertrial. In Indian judiciary several undertrials spend more time in prisons than the actual sentence would warrant them to spend because their case takes ages to come to court. So I found Dev's argument for being out flimsy and untenable. Yes, he has nowhere to go. So he should have stayed put in the prison.
