If courts do ask children their preference they word it clearly and simply and don't use the word custody with young children, they would simply ask who do you want to live with, mum or dad! It would be beyond ridiculous if these writers show even a judge being so incompetent to ask a child their preference in a custody case but not even bother using simple language with a child because you don't need to be a qualified judge to know children at that age haven't got a clue what custody means and what it involves, so judge would carefully explain things in a simple manner in a way a child would understand.

So such a misunderstanding would only occur if these foolish writers just for creative liberty show a judge not even bother explain in simple words to a child what custody is before making the decision.
