So acc to the Indian Evidence Act, a person missing is presumed dead after 7 yrs.

The show hasn't cleared their stance on whether Mandaar is missing or dead.

If dead the marriage is valid.

If missing then the person has to actually obtain from the court the presumed death certificate of the husband or wife and then a decree of divorce and only then they can remarry.

So if mandaar reappears and I presume it hasn't been seven years then definitely RaghVi's marriage is invalid.

Thanks for clarifying. I had thought the same, that their marriage would be invalid if Mandaar appeared/were still alive.

She will continue to be considered Mrs. Deshmukh then, as he has not disappeared for > 7 years. But here's my food for thought on HIS reason of disappearance, which can become valid grounds for divorce (based on FFs that I have read on this very forum + real cases):

(a) Bigamy: If he was married to someone before Pallavi, she is obviously not bound to him + no consummation + pretending to be dead and operating under a different identity elsewhere for 2 years.

(b) Financial Fraud: If he has embezzled funds, done window dressing of accounts even before those 2 years of operation, and shown loss when the shop was in profit, gambling away the funds for an easy win-loss scenario, he should be caught and jailed!

(c) Physical Violence: If there is a witness of how this guy pretended to be nice in front of his fam and Pallavi, but was actually an abusive prick who did not treat girls right in Hyderabad @ any level (mild --> intense; iTV standards), and that is why his unsuspecting parents were tricked into looking for a rishta in Kolhapur, and RR/Pallu can bring in witnesses to prove the same.

(d) Mental Disorder: If Pallu is forced to return back to the D-fam, and she finds that he is exhibiting signs of a mental disorder that could possibly put her life in peril, then it is possible to appeal for a divorce.

(e) Far-fetched theory, but if he has converted from Hinduism to Islam, to ensure he can be granted polygamy.

Wow, you've really thought this through, haven't you?! 🤣

Not sure about the Indian system, but under the circumstances, the first marriage can be annulled. A divorce may not be necessary because the husband disappeared on their wedding night itself and was presumed dead.
