Deepika: Guys...aaj Karan murder case ki hearing hai...I am going to the court...Will call you if I need anything...

Neha: Good luck Deepika...

As soon as Deepika reached the court she saw Armaan Malhotra talking to Mr. Kapoor....

Deepika: Oh great!...you again....upto your usual snooping I suppose?

Armaan: Hate to disappoint you...but no....

Deepika: whatever...
I would stop pestering Mr. Kapoor if I were you Mr. Malhotra...the defense lawyer, Riya Saha, seems to have a pretty good reputation....and I am sure Mr. Kapoor needs time to go over all the facts once again...

Mr. Kapoor: Thats what I was doing Deepika...I was discussing the case strategy with Armaan to make sure we didnt leave out any angle....

Deepika:...and Mr. Malhotra needs to be included in the discussion because...?

Mr. Kapoor:...because he is representing the State....(Seeing the surprised look on Deepika's face)...He is the prosecuting lawyer for this case...not me...I am just helping him out...

Deepika: (sarcastically) ...you are a lawyer now?....

Armaan: Well...I did my masters in criminal law...but I was always interested in journalism....so...did a diploma in mass communications and went in that direction....

Deepika:...then...why switch back?...

Armaan: (shrugging) just needed to prove something to myself....and the fact that this annoys the hell out of you has its added appeal....😛

Just then the Judge entered the courtroom and everyone stood up....

Judge: This is the time fixed for the preliminary hearing in the case of people vs Shikha Banerjee....Is the defense and the prosecution ready with the arguments?...

Riya: Ready on behalf of the defendent...

Armaan: We are ready your honour...

Judge: call in your first witness...

Armaan called Nikhil as the first witness....

Armaan: Mr. Nikhil...are you acquainted with the defendent,Shikha Banerjee?

Nikhil: yes...she is my ex-fiance....

Armaan: How long were you two engaged?

Nikhil: Three months...

Armaan: Was the defendent well acquainted with your house?

Nikhil: yes...she moved in with me immediately after the engagement...so...I would say she is pretty well acquainted with the house...

Armaan: Did you give her the keys of the house when she moved in with you?

Nikhil: Yes...I had given her a spare key...

Armaan: Do you have the spare key with you now?

Nikhil: No...I never took it back from her...

Armaan: Are you saying that the defendent still has the key to your house ?...

Riya: objection...leading the witness...

Judge:...sustained...

Armaan: ok...(showing a key present in a transparent envelope)...can you identify this key...

Nikhil: it looks similar to my house key...

Armaan: I would like to submit this key to the court as prosecution exhibit A....This key...irrespective of the fact of whether it was given to the defendent by Mr. Nikhil or not...can be used to get into Nikhil's house...which incidentally happens to be the scene of the crime....

This key...I must mention was found in the defendent's house and has her finger prints all over it....

Armaan: Nikhil...where were you on the 24th of Feb between 10 pm to 12 am?....

Nikhil: I left for Kolkata at 8.30 pm on that day....

Armaan: were you acquainted with the victim?

Nikhil: not well enough...Shikha had introduced Karan to me at a restaurant....thats the only time I met him...

Armaan: did you ever hear about him later?

Nikhil: Yeah...Shikha called me the next day to tell me that she was going out with Karan...I was surprised because the previous day Karan had told me that he was already seeing someone in Delhi....

Armaan: (looking at Riya)...your witness....

Riya: was the defendent aware that Karan was seeing someone else when she called you?...

Armaan: objection...asking for the conclusion of the witness...the witness cannot know the defendent's state of mind...

Judge:...sustained....

Riya: Why did you and Shikha break up?

Nikhil: ...because I was involved with another girl...

Riya: When did the defendent find out about this affair?

Nikhil: about a month back...

Riya: and you are still alive?

Nikhil: I beg your pardon...

Riya: If we go by the assumption that the defendent had a motive to kill the victim...because he had rejected her love...as the prosecution is trying to indicate...then she should have burried you alive...after all...you cheated on her...thats worse than getting rejected ...isnt it Mr. Nikhil?

Armaan: objection...argumentative...

Judge: sustained...you dont have to answer that...Mr. Nikhil...

Riya: No further questions....

Armaan called in the taxi drivers and the neighbors to establish the fact that Shikha had been seen near Nikhil's house with Karan on Sunday night (the night the crime took place) after 10 pm and that she was seen outside Nikhil's house on Monday morning at 9 am...

The court was adjourned for a short recess...

Outside the court...

Deepika: ...I am unable to figure out the defense counsel's strategy...

Armaan: Whats to figure out?....Usually in cases like this...the defense tries to prove that the defendent had an alibi...that the defendent was at a different place when the crime was committed...Unfortunately Shikha doesnt have an alibi...too many people had seen her in the vicinity of Nikhil's house with the victim on the night the crime was committed...
To get Shikha convicted we have to prove beyond reasonable doubt that Shikha had killed Karan...all the defense counsel has to do is raise a tiny doubt in the jury's mind that maybe Shikha didnt commit the crime....

Deepika: but we have forensic evidence which proves that Shika killed Karan...

Armaan: (turning and facing Deepika): about that....I will have to put you on stand while submitting the forensic evidence...and I am pretty sure the defense counsel will do anything to shred the evidencee to pieces....So...Ms. Deepika Ghosh its high time you gave me all the details of the case...and I mean ALL the details....

Deepika told Armaan everything about the case....even how she had gone into the house and how they had found the body....

After the recess the hearing continued....

Armaan: I would like to call Ms. Deepika Ghosh as my next witness....

Deepika came to the stand and took the oath...

Armaan: Ms. Deepika...you found the victim's body in Mr. Nikhil's house...am I correct?

Deepika: yes...

Armaan: Could you give the details of the cause and time of death to the court?

Deepika: The cause of death was a fatal blow to the head with a blunt object....the time of death was between 10:30 to 11:00 on Sunday night....

Armaan: Who tipped you off about the body?

Deepika: We recieved a missing person report...as part of that investigation we stumbled on to this body...

Armaan: Who filed that complaint...?

Deepika: the defendent had reported that her ex-boyfriend Nikhil was missing...we received the report four days after the day of the murder....

Armaan: Did the defendent ever report that her current boyfriend Mr. Karan was missing?

Deepika: No..we didnt receive any such report...

Armaan: When did you find Mr. Nikhil?...

Deepika: On 5th of March...He returned from kolkata that day...

Armaan: So...as far as you were concerned...the case was closed...then how did you stumble on to the body?

Deepika: We found evidence suggesting that a crime had taken place in Nikhil's house...so...we continued with the investiigation....

Armaan: After you found the body what did you do?

Deepika: We took Nikhil into custody...

Armaan: On what grounds?

Deepika: On the grounds that the body was found in his house...

Armaan: But didnt he have an alibi at the time of murder?

Deepika: yes...he did...But we had difficulties in determining the time of death initially as paint was poured on the victim's body slowing down the decomposition...

Armaan: Would you say...considering all the evidence...that someone was intentionally trying to frame Mr. Nikhil?

Riya: Objection...asking for the conclusion of the witness...

Armaan: the witness happens to be an expert in forensics...I am just asking for an experts opinion...

Judge: objection overruled...

Riya: fine...objected to as a leading question...

Judge: I will have to sustain that objection on the question in its present form Mr. Malhotra...

Armaan: Ms.Deepika...looking at all the facts...how does Mr. Nikhil fit into the case?

Deepika: He doesnt fit into the case at all...considering all the evidences...I would say someone was trying really hard to frame Mr. Nikhil...

Armaan: I would like to submit the fingerprints retrieved from the duct tape that was found at the scene of crime...as prosecution Exhibit B....

Riya: We raise an objection on the ground that it is incompetent;the evidence that the prosecution is referring to was taken as the result of an illegal search and is incompetent as evidence in this case...
In this regard, I would like to ask the witness a few questions ...

Judge: In connection with the objection which has been made, you may question the witness...

Riya: Did you have a search warrant when you made the search which lead you to the evidence in question?

Deepika: (hesitating) No...

Riya: You just went in and searched the house....

Deepika: I just went in....

Riya: (looking at Armaan) your witness...

Armaan: Did Mr. Nikhil raise an objection to the fact that you searched his house...

Deepika: No...he didnt...

Armaan: Did you find the evidence in question, when you searched Nikhil's house?

Deepika: In a way yes...But the evidence wasnt found in Nikhil's house during that search...
It was found on the victim's body during the autopsy...

Judge: The objection is overruled...Mr. Malhotra you may submit the evidence to the court...

Armaan: What were the results of the fingerprint analysis Ms. Deepika?...

Deepika: The fingerprints found on the duct tape match those of the defendent...

Armaan: No further questions...

Judge: The defense may cross-examine the witness...

Riya: Ms. Deepika ...does the fingerprint analysis give you the time when the fingerprints were left on the object ?....

Deepika: No...

Riya: So...for all you know the fingerprints could have been left by the defendent at the time when she was staying in Nikhil's house?

Deepika: We are talking about an adhesive tape here...fingerprints are usually left on the part which is being used...if these were left on the tape at an earlier point....then that part of the tape should have been used for a different purpose...the tape found on the victim doesnt show any previous usage...

Riya: So...do you mean to say its impossible for the fingerprints to have been left on the tape at an earlier point?

Deepika: (hesitating) I am not saying its impossible...

Riya: No further questions...

Armaan: I would like to ask the defendent Shikha Banerjee a few questions....

Armaan: Where were you on the 24th of Feb between 10 pm and 11pm?

Shikha: I went to see a friend....

Armaan: and What is the name of the friend whose house happened to be conveniently situated near Nikhil's house?

Shikha: Pooja Srivastav....

Armaan: So...I guess I should be talking to her first....

Shikha: (hesitating) I went to see her...but I came to know that she wasnt staying there anymore...So...I couldnt meet her...

Armaan: How do you know Ms. Pooja?

Shikha: We studied in the same college...

Armaan: When was the last time you met her?

Shikha: Couple of years back...

Armaan: Can you be more specific....

Shikha: (losing her cool)...I dont remember...alrite...

Armaan: Was there any specific reason why you wanted to meet Ms. Pooja after so long?

Shikha: No...

Armaan: (skeptically)...let me get this straight....you decided...totally out of the blue...to pay a social visit to a schoolmate with whom you havent spoken in years...without even being sure of her address...at 10 pm in the night....is that correct?

Shikha: (getting a little nervous)...Its not like that..I met Pooja two months back....

Armaan: really...I thought you said ...you had last met her couple of years back?...

Shikha: I forgot...

Armaan: I suggest you keep your facts right Ms. Shikha...Did you go to see your friend alone?

Shikha: No...Karan was with me...

Armaan: Did you go to Nikhil's house the next day at 9 am?

Shikha: Yes...

Armaan: Why?

Shikha: I wanted to return his stuff...

Armaan: Was Karan with you then?

Shikha: No...he was to leave for Delhi by the morning flight...

Armaan: you thought it was more important to return your ex-boyfriends stuff...which must have been with you for months...than to see-off your current boyfriend?

Riya: objection...I dont see what the prosecution is trying to prove here with that question...the defendent's priorities are her own....

Judge: the objection is sustained....

Armaan: Did you speak to Karan before he got onto the flight?

Shikha:No...

Armaan: Did you speak to Karan after he was supposed to reach Delhi?

Shikha: No...

Armaan: You didnt find it odd that he never called you?...Or are you used to people treating you that way?

Shikha didnt answer ...

Armaan: Do you still have feelings for Mr. Nikhil?

Shikha: No...

Armaan: and yet you filed a complaint that your ex was missing...shouldnt you have been more concerned about your present boyfriend?

(sarcastically)....Are you sure you were going out with Karan?

Shikha:(getting angry)..yes...

Armaan: Did you know that Mr. Nikhil was cheating on you when you were engaged? ...

There was anger visible in her expression...

Shikha: Thats the reason we broke up....

Armaan: I didnt ask you if that was the reason you broke up...I asked you whether or not you knew.....

Shikha: (glaring at Armaan 😡)....yes...I knew he was cheating on me....

Armaan: Did you know that when you reported that Nikhil was missing...he was actually in kolkata...where his girlfriend gave birth to his baby?

Shikha clentched her fists in anger and glared at Nikhil...😡

Armaan: Answer the question Ms. Shikha...

Shikha: (snapping at Armaan) Dont you dare order me around...

Judge: your not answering the question will be considered as contempt of court...

Shikha: (looking at Armaan)...No..I didnt know that...

Armaan: Were you going out with the victim?

Shikha: yes...

Armaan: Did you know that Karan had a girlfriend in Delhi...and he had every intention of marrying her?

Shikha: (bitterly) No...He was gonna break up with her...

Armaan: How did you reach Nikhil's house on Monday?

Shikha: I took a cab...

Armaan: How come no one saw you come in a cab on Monday?...for that matter no one saw you leave the area on Sunday nite either...how come?

Shikha: (panicking)...I dont know...

Armaan: You were in Nikhil's house the whole of Sunday nite...werent you Ms. Shikha?....you never left the place...and neither did Karan...did he?

Riya: objected to as incompetent argument...

Shikha: (nervous)...I...I reached there in the morning...you cant prove a word of what you are saying....

Armaan: Dont be so sure Ms. Shikha...Would you be able to explain to the court why your fingerprints were found on the piece of duct tape which was used to tie Karan's hands?

Shikha: (absent mindedly snapped at Armaan)...thats impossible...I didnt tie his hands...I just used it to wrap the bedcover around...( Shikha gasped realizing what she had just said)...

She looked at her lawyer...who just shook her head ....😕

Armaan: No further questions your honour....
