Reacting to the Supreme court's latest judgement, Rhea Chakraborty's lawyer has said that his client's case has lost total steam in the merits of the allegations by the virtue of the judgement.

On Thursday, the Supreme court held that a statement recorded under its Section 67 cannot be used as a confession in the trial of an offense under the NDPS (Narcotics Drugs and Psychotropic Substances) act. By ruling out 2:1, a three-judge bench overruled two previous Supreme Court verdicts to hold that the statements of the accused recorded under Section 67 cannot be used as confessions during the trial. Reacting to the same, Rhea Chakraborty's lawyer Satish Maneshide has issued a statement.

"The Judgement rendered by the Hon'ble Supreme Court in respect of Section 67 of the NDPS Act is a Landmark pronouncement. A large number of people have been incarcerated and punished on the basis of statements forcibly extracted by using third degree, coercion and threats to innocent individuals violating their Fundamental Rights in the last 35 years," he said in an official statement issued to the price.

Maneshinde went on to say even in the case of all accused in the Sushant Singh Rajput drugs angle case, thereโ€™ is hardly any recovery and independent evidence to charge them of serious offenses. According to Rhea's lawyer, they are languishing in custody on the basis of inadmissible statements. And in view of the judgment rendered by Justice Rohington Nariman and Navin Sinha, a large number of accused will finally see the light of the day.

He added that Justice Nariman had rendered a judgement under PMLA in respect of section 45 which paved the way for a large number of people languishing in custody illegally were released on bail. According to him, Justice Nariman will go down in history as one of the greatest judges and will be remembered for all times to come by those fighting for Human Rights.

They took her so called confession as evidence to SC? Is that even allowed? I thought its not even admissable in court , but Manshinde is calling this a landmark judgement, does that mean in the past it was allowed? ๐Ÿ˜ณ Somebody explain this to me. I had a very different understanding of this.

No no, this is not the official appeal of the NCB but this has everything to do with Rhea's case.


This hearing was related to the section 67 of the NDPS act which has come under major scrutiny for the past two years and was being fought in court for sometime.


Basically, the act made by the NDPS gives them immense power to question & summon anyone just based off whatsapp messages & phone calls. Like they questioned everyone off whatsapp chats in this case from Rhea to Deepika to Shraddha.


The Supreme court considered this unconstitutional and ripped them off this major power. Messages can be considered evidence and should be used as leads but people can't be locked up just based on messages & statements under duress. The NCB needs to do better just like every other agency around the world.

Not necessarily. Showik is in judicial custody which can be extended upto 90 days. They had to let him go after 90 days anyways but they'll certainly stretch it to the full 90 days. Just his statements wont be admissable in court so unless they can recover some product, they'll never be able to make a case against him and actually get him arrested(different from custody).

This is a sensible verdict as the misuse of power by agency was very evident in such a high profile case. Canโ€™t imagine the number of victims who who would have suffered under this
