But now it's cheating because they were already warned against touching or fiddling with any task related stuff

I would have agreed with the strategy ,
If he would have done it during the task .

But outside task , while everyone's sleeping ,
Despite the announcement ,
Changing the positions of the diamond is CHEATING !
