Court looks at many factor. ( these all are based on whatever i seen or read)

1. Financial stability: abhinav has lost their only source of income. And abhir's education may have problem staying with navra. Regarding taking help from goenka they still can say akshu refused it earlier she can refuse it in future too. And even in current situation they decided to sell their cars than taking help. So it's not so evident to tell in future if she will not hesitate to take help.

2. If the party are able to prove that mother or father were careless in handling kid. That might impact judgement. Akshu kind of delayed treatment just because she don't want to face abhi. She ignored taking help from goenka and birla because she had a problem with them when she was pregnant. What will she say to the court I heard them they don't trust me so I chose to stay with a stranger. Even abhi knows abhir had breathing issues which akshara did not know. That shows abhir trusts docman too. The court may not agree to this argument.

3. Akshu hid the identity of kid from abhimanyu. Usually it's not correct to hide child's detail. Akshu should have sent a letter or something. As court needs proofs. She should have sent a registered post.

4. If abhi is not involved in court drama manju can even go to the extent of proving akshu as characterless as all things that she did is against her situation. She ran away and immediately married a stranger without even waiting for an year to complete.

I feel abhi's case is stronger compared to akshu as akshu Don't have any evidence to prove what happend on white day to prove abhi is wrong as goenkas were not present and arohi will not go against abhi and shefali also adores abhi.

Regarding white day - if abhi can prove akshara was laparvah and it led to miscarriage then it will be proven historically she has again and again put herself and her kid in danger.

See I being the law student. I can tell you that ak ka case jyada strong hei and if abhi confesses all in court toh sab gaya and abhi ek aisa insan hei jo custody k liye chup nhi rahega and mj ne jo jo kiya hei agar uske hi mu se uglwa lenge toh voh b gaya aur us din the way mj treated her all are the witness to the situation aur financial matter solve hogi agar kv step up karega toh. Usually itv mei ma ko jeete huye hi dekha sakte hei. And we can't say ak has proof or not voh toh tab pata chalega jab track aayega. She is studying law that's their is a reason for it.

I have seen that naira had no valid reasons to hide the kid and also neither karthik Or family never ever HARRASSED her kartik asked one question because he had a doubt but then immediately he apologied to her. Also kartik was shown to regret for all the time. And also naira had very less valid points with her. But ak k mamla kafi different hei. She was harassed mentally and physically very badly and was thrown out and rejected by her hubby when she was pregnant/ miss carried which comes under dv.

Akshu ne uspar koi courtesy nahi dikhayi. So he will also show any remorse in initial court sessions. Akshu may studied law as currently she has no money to hire a good lawyer.

Her proof is abhi who will only speak in the end when ppl blame akshu for being bad mother and wife.

This is when he will give samman to her which she always asked for. He will prove himself as bad father and husband and leave everything.
